Ashley & Martin responds to Federal Court ruling
Ashley and Martin, Australia and New Zealand’s leading medical hair centre, is disappointed with today’s Federal Court ruling that concerned some of the conditions found in historical customer contracts that are no longer used by Ashley & Martin.
Ashley & Martin is carefully considering the Court’s judgment and will seek advice in the coming days about whether or not it should appeal the decision.
Since June 2016, Ashley and Martin has corresponded extensively with the Australian Competition and Consumer Commission (ACCC) to address their concerns, and in July 2017 updated all of their patient contract terms, which included the addition of transparent termination fees.
In addition, since July 2017, the organisation has led industry best practice in Australia through the implementation of a seven-day cooling off period, allowing customers to “opt out” of their contracts. To their knowledge, Ashley and Martin is the only company in the industry providing this option.
Furthermore, as guided by the ACCC, Ashley and Martin provided a redress for those patients wishing to cancel their Personal RealGROWTH Program, against the terms of the new contract. This redress occurred during July 2017.
The cost of the Personal RealGROWTH Program ranges from $2,400 to $4,800 depending on the length and treatment required. Patients have the option to pay in monthly instalments rather than a total upfront fee, and Ashley and Martin provides a full money back guarantee should the treatment not prove successful after eight to 12 months.

Treatment will only proceed if the treating clinician considers it efficacious for their patient, and if the they have obtained their patient’s informed consent.
