Minister calls in review of approval conditions for Safe Night Space

Planning Minister John Carey has made the decision to call in the State Administrative Tribunal (SAT) application for review of the conditions imposed on the Ruah Safe Night Space development approval, in accordance with the Planning and Development Act 2005.

A Direction Notice was issued to the State Administrative Tribunal President on 15 March 2024 to refer an application for review for Ministerial determination.

The application was lodged initially on behalf of Ruah Community Services, for a review of the conditions of approval applied by the City of Perth to a change of use application that would enable the Safe Night Space service to operate temporarily from its existing premises in James Street, Northbridge.

Under section 246 of the Planning and Development Act 2005, a planning application that is considered to raise issues of State or regional importance can be called in to be determined by the Minister for Planning. Further, section 247 of the Act states that in determining an application for review, the Minister for Planning is not limited to planning considerations but may have regard to any other matter affecting the public interest.

Authority to consider and determine this review application will be transferred to Minister Amber-Jade Sanderson.

“As Planning Minister, I have made the decision to call in the review of approval conditions for the Safe Night Space for ministerial determination under the Planning and Development Act 2005.

“I have been advised that I do not, in these circumstances, have a conflict of interest in this matter.

“However, I also consider that there is a minor risk of a perception of conflict of interest and have asked that authority to consider and determine this review application be transferred to Minister Amber-Jade Sanderson.”
