Police Charge Man Over Visa Breach 5 March

A Sudanese-born man is expected to appear in the Melbourne Magistrates Court today (Tuesday 5 March, 2024) charged with failing to comply with his visa mandated reporting conditions and breach of bail.

The AFP arrested and charged the man, 37, today (5 March, 2024), after locating him in Melbourne, Victoria.

It will be alleged the man breached the conditions of his Commonwealth visa between 17 January and 29 February, 2024, by failing to report as directed.

The man has been charged with:

  • Failing to comply with a requirement of the monitoring condition, contrary to section 76B (1) of the Migration Act 1958 (Cth);
  • Commit Indicatable Offences While on Bail, contrary to section 30B of the Bail Act 1977 (Vic); and
  • Fail to Comply with Conditions of Bail, contrary to section 30A (1) of the Bail Act 1977 (Vic).

The offence Failing to comply with a requirement of the monitoring condition, contrary to section 76B (1) of the Migration Act 1958 (Cth) carries a maximum penalty of five years’ imprisonment and a $93,900 fine.
