The Therapeutic Goods Administration (TGA) has accepted a court enforceable undertaking by Strapit Medical and Sports Supplies Pty Ltd in relation to alleged advertising breaches that implied face masks advertised on their website were approved by the TGA.
It is alleged that Strapit Medical and Sports Supplies Pty Ltd advertised face masks on their website in a way that indicated they were included in the Australian Register of Therapeutic Goods (ARTG), however the advertising referred to two cancelled ARTG entries.
The undertaking is enforceable for a period of three years, and under the Therapeutic Goods Act 1989 is required to be published.
Two infringement notices totalling $26,640 were also issued to Strapit Medical and Sports Supplies Pty Ltd.
The TGA undertakes post-market reviews of face masks included in the ARTG. Consumers are able to check whether the goods they are purchasing have been cancelled from the ARTG by searching the database located at Post-market review of face masks: Cancelled ARTG entries or by Searching the Australian Register of Therapeutic Goods.
