Cormack’s Plumbing Services Pty Ltd faces two charges under section 21(1) of the Occupational Health and Safety Act of failing to provide and maintain a safe workplace.
WorkSafe alleges the company twice breached section 21(1)(a) of the OHS Act by failing to provide and maintain plant and systems of work that were, so far as reasonably practicable, safe and without risks to health.
Texco Construction (Vic) Pty Ltd faces a single charge under section 26(1) of the OHS Act for failing to ensure that a workplace under its management or control was safe and without risks to health.
The worker was seriously injured when he was crushed between the rail of the elevated work platform, which did not have secondary guarding installed, and an overhead pipe while undertaking plumbing work at a warehouse under construction, in July 2023.
Both matters are listed for committal mention at the Melbourne Magistrates’ Court on 28 February 2025.
