You can have your say On Mental Health Law Reforms

The ACT Government is inviting people with lived experience of the mental health system, along with their families, kin and carers to help shape the future of mental health in Canberra.

A review of key parts of the Mental Health Act 2015 is now underway. The public consultation contains 15 sections which are part of the mandatory review and 7 additional areas related to the Mental Health Act.

People are encouraged to share their experiences, insights and ideas on how the legislation meets the needs of people with a mental illness or mental disorder and the people who care for them.

The review will consider whether the legislation is providing the right protections, support and safeguards across a range of important issues, including:

  • the health, wellbeing and safety of people subject to mental health orders and forensic mental health orders
  • how information is shared with families, kin and carers
  • apprehension and contravention of a mental health order
  • review of detention under a court order
  • emergency detention
  • sexual safety protections
  • reporting requirements following deaths.

Minister for Mental Health, Dr Marisa Paterson, said hearing directly from people with lived and living experience is critical to ensuring the legislation continues to meet the needs of the community.

“No one understand the strengths and challenges of the mental health system better than the people who use it, and the families, carers and supporters who walk alongside them,” Dr Paterson said.

“Every experience and perspective matters. We are especially keen to hear from Aboriginal and Torres Strait Islander peoples, members of the LGBTIQA+ community, and people from culturally and linguistically diverse backgrounds. Your insights are invaluable, and I warmly encourage you to share your experience.”
