Consultation for Guidance on Transparency in Automated Decision Making

3 July 2026

PWDA prepared this submission in collaboration with, and on behalf of Inclusion Australia, Children and Young People with Disability Australia, and with input from the Justice and Equity Centre.

The Office of the Information Commission (OAIC) is developing guidance on how automated decision-making (ADM) should be used. Using ADM means a computer helps with, or replaces parts of, the decision making process with algorithms.

People with Disability Australia, Inclusion Australia and Children and Young People with Disability Australia are concerned that without the correct rules, using ADM could make mistakes or harm people, so we prepared a submission.

This submission continues our previous work where we have explained the problems and asked for change when ADM or algorithms have been used to decide matters like NDIS claims, raising debts against people who receive income support payments, and in the generation of ‘Robodebt’.

Using computers to replace human decision makers isn’t an improvement if it leads to greater harm to, or discrimination against, people.
