An Expert Panel of the Fair Work Commission has published a decision proposing to make a minimum standards order. This draft order would cover employee-like workers involved predominantly in the on-demand delivery of consumables or supermarket groceries. It would also cover the platforms that engage them.
We have published the draft order and prepared a fact sheet about the draft order. The fact sheet provides an overview of who the draft order would cover, what is included and other relevant information.
If the Expert Panel decides to make an order based on the draft, it would start on 10 August 2026. The order, if made, is intended to be temporary and would be reviewed within 21 days of a notice of intent and draft order being published in the separate but related MS2024/1 or MS2024/2 cases.
