The ABCC has obtained a temporary injunction against the CFMMEU preventing it from continuing to organise unlawful industrial action at the Inner City South State Secondary College project site at Dutton Park in Brisbane.
The temporary injunction requires the CFMMEU and its officials to withdraw any direction, authorisation or encouragement of unlawful industrial action to the 130 strong workforce at the site.
Construction commenced in November 2019 and was scheduled to be completed by February 2021. The alleged unlawful industrial action has threatened the completion of the $130 million school in time for the start of the new school year.
The ABCC alleged the CFMMEU and its officials Andrew Blakely and Dean Mattas organised the unlawful industrial action to coerce the head building contractor to remove its project manager from the site.
The ABCC also alleged the unlawful industrial action and demand to have the project manager removed coincided with the head contractor refusing to sign up to a CFMMEU state-wide enterprise agreement.
In its application for the temporary injunction the ABCC claimed the scale of the drop off in numbers of workers attending the site reflected the existence and continuance of a ‘ban’ of any building work being performed on the site.
The new school will be located within the Brisbane Knowledge Corridor, an education, health, research and hospital precinct. When completed the school is expected to cater for around 1,500 students.
