This week Council attended a conciliation conference with the Applicant of a Development Application on 16 Crooked River Road, Gerroa.

On 6 June 2022, representatives of Kiama Municipal Council participated in a conciliation conference with the Applicant of development application no. DA 10.2020.190.1 (the DA) before a Commissioner of the NSW Land and Environment Court.

The DA seeks approval for the construction of a primary and secondary dwelling, pools (x2), a shed, driveway and wood heaters (x2) at 16 Crooked River Road, Gerroa.

The conciliation conference took place in accordance with the orders of the Court in circumstances where the Applicant appealed Council’s decision to refuse the DA to the Court.

The conciliation conference commenced on-site at 16 Crooked River Road and parties who lodged an objection to the DA were given the opportunity to inform the Commissioner on-site of their concerns regarding the proposed development.

Following the conclusion of the on-site inspection and after hearing from objectors, the parties returned to Council to continue confidential and without prejudice discussions in accordance with the Court’s orders and Conciliation Conference Policy.

It is the duty of each party to proceedings where a conciliation conference has been arranged by the Court to participate, in good faith, in the conciliation conference. This process provides an opportunity for the Applicant to hear and attempt to address the concerns identified by the community and Council.

The matter remains the subject of ongoing confidential and without prejudice discussions between the parties and the s34AA conciliation conference has been adjourned until the afternoon of 22 June 2022.

Council will provide a further update once these proceedings are no longer the subject of confidential and without prejudice discussions between the parties.
