Draft DCP Amendments – Bella Vista and Kellyville Station Precincts

At its Meeting of 24 May 2022, Council resolved to publicly exhibit Draft amendments to Part D Section XX – Bella Vista and Kellyville Station Precincts and Part D Section 7 – Balmoral Road Release Area of The Hills Development Control Plan (DCP) 2012. The amendments will be on public exhibition from Friday 10 June 2022 to Monday 11 July 2022.

A new draft DCP Section is proposed for the Bella Vista and Kellyville Station Precinct to regulate future built form and ensure high quality development outcomes that reflect the intended character for the Precinct as a highly liveable transit centre. This new DCP Section only applies to areas of the Bella Vista and Kellyville Station Precincts which are not subject to the State Significant Development Applications (SSDA) submitted by Landcom. The SSDA applies to the majority of the precincts and development outcomes in these locations are expected to be guided by Urban Design Guidelines that form part of the SSDA.

Amendments are also proposed to Part D Section 7 – Balmoral Road Release Area of the DCP to avoid duplication of development controls and facilitate orderly development for adjacent land that was also rezoned as part of the Government’s Planned Precinct Program in 2017.

It is noted that the proposed DCP amendments do not seek to reconsider or revisit any of the precinct planning, land use, density or built form outcomes that were implemented as part of the Department’s Planned Precinct Program in 2017. The proposed amendments are necessary simply to ensure Council’s Development Control Plan reflects the rezoning implemented by the State Government in 2017 and provides suitable development controls to guide future development applications on the small areas of land within the Precinct which are not subject to the SSDA.

Following the exhibition period, the outcomes of the public exhibition will be reported to Council for a decision on whether to adopt the proposed DCP amendments. However, please note that this will not occur until such time that the SSDAs have been determined by Government, to ensure Council has certainty of future development outcomes within the Precincts.
