LEP Amendment 37, Shiralee DCP Amendment and Voluntary Planning Agreement (VPA)

Orange City Council placed a proposed amendment (Amendment 37) to the Orange Local Environmental Plan2011, an associated amendment to the Shiralee DCP and a Voluntary Planning Agreement on public exhibition for comment. Submissions on this amendment closed 5pm Wednesday 14 February 2024.

The proposal relates to rezoning and altering the minimum lot size for subdivision in relation to land at 12-20 Shiralee Road (Lot 1 DP630681, Lot A DP381933, Lot 1 DP381932 and Lot A DP381935). The proposed changes would result in a reduction of the RE1 Public Open Space area of the site, enable an additional 47 residential lots, development and embellishment of the remaining RE1 Public Open space by the developer and dedication of the completed park to Council.

It is proposed that the 47 additional residential lots be excluded from the complying development provisions of State Environmental Planning Policy (Exempt and Complying Development) 2008. Development of the 47 additional lots shall therefore be assessed as Development Applications under the LEP and Shiralee DCP provisions. To facilitate DA assessments the proposal includes an amendment to the Shiralee DCP to introduce additional lot typologies and design requirements for these 47 lots.

An associated Voluntary Planning Agreement (VPA) forms part of the exhibition and addresses embellishment and dedication of the parkland to an agreed standard and design.
