‘Use it or lose it’ conditions for LPON licensees

The Australian Communications and Media Authority (the ACMA) has recently published a report and factsheet for LPON licensees on the application of the ‘use it or lose it’ (UIOLI) licence conditions. This follows two recent decisions of the Administrative Appeals Tribunal (AAT) affirming our decisions to cancel a number of LPON licences held by the applicants to the AAT proceedings.

The report does not signal a new direction in the ACMA’s approach to the UIOLI regulatory arrangements. Rather, it is intended to clarify the existing regulatory arrangements in light of the AAT’s decisions and assist LPON licensees to access information and guidance provided in the judgements to interpret the application of the UIOLI conditions.

In doing so, our report is intended to assist LPON licensees to better understand their responsibilities under the UIOLI conditions relating to commencement of service, the regular provision of service for the duration of the licence and maintaining records, as well as our role in administering this regulatory framework.
