Abolition of ABCC and ROC

Find information about the abolition of the Australian Building and Construction Commission (ABCC), the former workplace regulator of the commercial building and construction industry.

We also cover the abolition of the Registered Organisations Commission (ROC), the regulator of unions and employer groups.

Abolition of the ABCC

On 10 November 2022, certain functions and responsibilities under the Fair Work Act carried out by the ABCC for the commercial building and construction industry transferred to us (the Fair Work Ombudsman).

The changes mean the ABCC is in a transition period until it is abolished on 6 February 2023. This will enable a range of information and documents to transfer to us.

All ongoing legal matters currently before the courts have now transferred to us.

All building and construction industry employers and employees can seek workplace information, advice and assistance from us. Find out more at Important information for the building and construction industry.

You can learn more on the ABCC’s website Secure Jobs, Better Pay Act now in force.

A new National Construction Industry Forum will also be established from 1 July 2023. This organisation will operate as a statutory advisory body to the Government on workplace issues in the building and construction industry. Find out more via the Department of Employment and Workplace Relations fact sheet National Construction Industry Forum.

Abolition of the ROC

From no later than 6 June 2023, the Registered Organisations Commissioner’s regulatory powers and functions will transfer to the General Manager of the Fair Work Commission (the Commission) and the ROC will be abolished.

There will be new enforcement options for the regulation of registered organisations, which the General Manager of the Commission will administer. This includes infringement notices and enforceable undertakings.
