Ending employment of private building surveyor

When all three parties agree to the transfer of function of a private building surveyor (PBS), an application for the VBA consent to terminate is not required.

The Victorian Building Authority (VBA) has been receiving applications for consent to terminate the appointment of a PBS when all three parties agree to the transfer of function.

If all three parties agree, and the PBS is willing to action a transfer of their functions under section 80C of the Building Act 1993, it is not necessary for the VBA to process an application for consent to terminate.

The VBA will only provide consent in specific circumstances. If these circumstances are not met, the VBA may decline consent, even where the PBS agrees. The applicant may appeal any decision made by the VBA to decline consent to the Building Appeals Board (BAB).

The process of terminating the PBS may take several weeks, as the VBA must communicate directly with the relevant stakeholders and fully consider all the circumstances during the application process.

A PBS cannot action a transfer of function if more than one building surveyor has been appointed for the same building work.
