NSW Government Nitrous Oxide Rules Now In Effect

From today, new restrictions on the sale and supply of nitrous oxide will commence.

The new regulations are aimed at reducing the harms associated with misuse of the substance often used as a recreational party drug referred to as “nangs”.

A public awareness campaign has also commenced to increase community awareness of the harms of nitrous oxide misuse, and ensure retailers and suppliers are ready to comply with the regulations.

Under the changes retailers must not:

  • Sell nitrous oxide to people under 18
  • Sell canisters containing more than 10 grams of nitrous oxide directly to consumers
  • Sell more than 250 grams of nitrous oxide to an individual in one day
  • Sell nitrous oxide between 10 pm and 5 am
  • Offer same-day delivery
  • Display nitrous oxide products or packaging where customers can see them.

The requirements apply to retailers, wholesalers, online sellers and businesses selling or distributing nitrous oxide in NSW.

Access for legitimate uses such as food preparation, medical, automotive and industrial uses will remain unchanged.

With enforcement powers now in effect, NSW Health will provide guidance to retailers on compliance requirements, and may issue warnings, or seize products supplied in breach of the regulation.

Businesses and individuals who fail to comply with the new regulations may also face financial penalties.

Nitrous oxide misuse has been linked to serious harms, including severe vitamin B12 deficiency, permanent neurological injury and serious mental health effects.

Acute and chronic use can also result in severe frostbite, lung injuries, cardiac abnormalities, asphyxiation, and injuries associated with falls.

The new regulations, part of the Medicines, Poisons and Therapeutic Goods Regulation 2026, were developed following extensive consultation with key stakeholders including health practitioner groups, industry and government agencies.

Quotes attributable to Minister for Health Ryan Park:

“This is an important change that will hopefully see fewer young people fall victim to the harms of nitrous oxide misuse.

“These new regulations find the right balance between restricting access to this harmful party drug, while ensuring it is still available for legitimate uses.

“This isn’t just about cracking down on the sale or supply of the product – we also want to educate the public, including young people and their families about the serious risks associated with nitrous oxide misuse.

“I want to acknowledge and thank Sam Bramman, a strong and dedicated advocate who has used his personal experience to educate others and push for this regulation change that takes effect today.”

Quotes attributable to advocate Sam Bramman:

“At 19, nangs put me into psychosis and I ended up spending two months in a psychiatric ward. Today’s laws mean fewer young people in NSW will go down that path.

“I ran 300km from Sydney to Parliament House because I wanted to make sure no other family goes through what mine did. I am passionate about raising awareness around the harms caused by nangs.

“NSW is a strong start, but we need unified rules right across Australia on nang sales and delivery so every state has the same standard.”
