NT Judicial Commission Starts Work

NT Government

Territorians can now access an independent body to investigate complaints about the behaviour or capacity of judicial officers and ordinary members of NTCAT.

The Judicial Commission begins work today, and was established by the Territory Labor Government to increase the transparency and accountability of the judicial branch of government without undermining judicial independence.

Examples include:

· Unreasonable delay in handing down a judgement;

· Inappropriate comments or questions in court;

· Bullying or sexual harassment.

Members of the Judicial Commission include the Chief Justice of the Supreme Court, the Chief Judge of the Local Court, the President of NTCAT, the President of the Law Society NT and a community member of high standing.

The latter position has been taken by long-term Darwin resident Sabaratnam Prathapan, following a call for expressions of interest.

The Judicial Commission will investigate all valid complaints and will either:

· Dismiss the complaint;

· Refer it to the head of the relevant court or tribunal with recommendations for action;

· Establish an investigation panel to deal with the most serious complaints.

The Judicial Commission will reinforce the highest standards of accountability and will increase public confidence in the justice system.
