VCAT upholds Council planning refusal in Glen Iris

The City of Stonnington is pleased that the Victorian Civil and Administrative Tribunal (VCAT) has upheld Council’s planning refusal for an application at 173 Burke Road, Glen Iris.

Following 198 objections, the application was initially refused by Council in 2021 as the proposed development:

  • was excessive in size
  • would result in unacceptable visual bulk
  • was not respectful of adjoining residential areas or the scale of the Activity Centre
  • would result in unacceptable traffic and car parking impacts.

Following this refusal, the applicant appealed Council’s refusal to VCAT where Council was joined by 28 objectors in support of the refusal being upheld.

On 9 May, VCAT advised that “the responsible authority’s decision is affirmed. No permit is granted”.

In their findings, tribunal members agreed the scale and design of the application was not suited to the local amenity and also outlined concerns about the impact on local traffic. You can read VCAT’s decision in full on their website.

City of Stonnington Deputy Mayor, Cr Melina Sehr, is pleased that Council and local residents have been supported by VCAT.

“We’re delighted with VCAT’s decision to confirm Council’s decision to refuse this planning application. The application presented a number of issues that concerned local residents, in particular urban design issues and local traffic conditions. This is a great final outcome, and I thank local residents for their commitment in fighting this alongside their Council,” said Cr Sehr.
