Master Builders’ unproven attacks risk being in legal contempt

A media release distributed by Master Builders Australia today treats allegations made against the CFMEU as fact and risks being in contempt of legal proceedings, the union warns.

The MBA release refers to proceedings that have been launched by the ABCC against the NSW CFMEU, notice of which was served against the union late last week.

“This matter will be defended and the allegations against the union rigorously contested,” said Darren Greenfield, NSW CFMEU Secretary.

“The issues raised by the MBA have not yet been the subject of any proceedings at all and no evidence has been heard, nor has it been tested. It is contemptuous in the extreme for the MBA to treat unproven allegations as fact in an attempt to score political points.”

“Their behaviour shows a contempt for due legal process. The union will ensure the court is made aware of this behaviour.”

“It is telling that the MBA’s first instinct is to abandon principles of fairness before the law in order to achieve their political ends.”

“It’s a pity the MBA isn’t so quick to condemn companies who kill workers or steal their wages and conditions.”

“In truth, the MBA and the ABCC have long been complicit in supporting the Liberal Government’s ideologically driven war on ordinary workers.”

“The MBA and ABCC act in cahoots to attack the CFMEU while billions of dollars of superannuation and other conditions are stolen from workers and subbies are ripped off by unscrupulous builders and developers, who are also responsible for the apartment construction crisis which is leaving consumers stripped of their homes.”

“It shows clearly where the MBAs and ABCC’s priorities lie, not in holding dodgy builders to account and making the industry safer, but in propping up the race to the bottom.”
