An approved education and care provider in Treeby has been penalised after a 6-year-old boy exited the service premises through the school gates and ran home.
OSHClub Pty Ltd, which operates the approved service Treeby OSHClub, was ordered to pay $30,000 by the State Administrative Tribunal (SAT) following the incident, which occurred on 6 October 2025.
After exiting the school grounds, the child ran across roads and through a busy shopping centre complex car park. Whilst the child was found at his home unharmed the roads and car parks crossed put the child at high risk of injury. There are also inherent risks with the child being alone and unsupervised in a busy shopping centre precinct.
A Department of Communities (Communities) investigation found that the provider had breached the Education and Care Services National Law (WA) by failing to adequately supervise a child in their care.

As stated by Angelo Barbaro, Executive Director, Regulation and Quality, Department of Communities:
“Services must ensure that their staff are prepared to actively supervise all children in their care, no matter their needs or circumstances.
“Inadequate supervision within the education and care services sector is a significant concern of Communities.
“Even a momentary lapse of supervision can significantly increase the risk of harm to children.
“We urge approved providers to ensure constant, adequate supervision to keep children safe and to avoid being penalised.”
